Supreme Court Halts Uttarakhand High Court's Order

The Supreme Court has intervened in the Uttarakhand High Court's decision to relocate the court premises from Nainital, a popular tourist destination.
A Vacation Bench led by Justice P.S. Narasimha has stayed the High Court's order, freezing its directive for the state government to find an alternative site outside Nainital for the court's relocation.


The stay will remain in effect until the next hearing, scheduled immediately after the summer vacation. The decision came in response to a petition filed by the Uttarakhand High Court Bar Association, arguing that only Parliament or the Central government holds the authority to determine the establishment of a Principal Bench, not the High Court.


The High Court's earlier rejection of land allocation for the court at Haldwani led to the directive for relocation, citing better public and litigant interests.
The High Court's order mandated the identification of land for the court, residential accommodations, courtrooms, conference halls, chambers for lawyers, canteen facilities, and parking spaces, with a deadline for the Chief Secretary to submit a report by June 7.
