Uttarakhand High Court Stays Recovery Notice Sent to Haldwani Violence Accused
In a recent development concerning the aftermath of the Haldwani Banbhulpura violence, the Uttarakhand High Court has intervened to stay a recovery notice amounting to ₹2.42 crore sent by the Municipal Corporation to Abdul Malik, the alleged main perpetrator in the incident.
The decision, rendered by a single bench presided over by senior Justice Manoj Kumar Tiwari, comes after careful deliberation and a thorough examination of the case's legal intricacies.
The violence, which erupted on February 8, 2024, in Banbhulpura, Haldwani, saw a flurry of destructive activities, including stone-pelting, torching of vehicles, and the besieging of the local police station by an agitated mob.
Tragically, the confrontation resulted in the loss of four lives and left over 250 law enforcement officers injured. Amid the chaos, the Banbhulpura police station fell victim to flames, compelling authorities to enforce a curfew across the entire town for a period of two days.
In the wake of the violence, the Municipal Corporation issued a recovery notice to Abdul Malik on February 12, 2024, demanding the hefty sum of ₹2.42 crore within a mere three-day window. The notice attributed the financial liability to Malik, holding him accountable as the primary accused in the mayhem that ensued in Banbhulpura.
The demand for compensation purportedly aimed to cover the extensive losses incurred during the riots, including damage to government property valued in crores of rupees.
Challenging the veracity of the allegations leveled against him, Abdul Malik took recourse to legal avenues, contending that the accusations remained unproven and subject to the ongoing judicial proceedings.
Despite Malik's assertions, the administration pressed forward with its efforts to recover the stipulated amount, culminating in the issuance of a subsequent recovery notice by the Haldwani Tehsildar on April 25, 2024.
In response to the mounting legal challenge mounted by Malik, Justice Manoj Kumar Tiwari, in a display of judicial prudence, has temporarily halted the execution of the recovery notice.
The court's intervention not only provides interim respite to Malik but also underscores the pivotal role of due process in adjudicating contentious matters such as this.
